These Terms of Use (the "Terms") govern your use of the Mobile App TaskFLY (hereinafter referred to as the "Application") developed by AESA Group, SE ("we", "us" or "our"). By using the App, you agree to these Terms and agree to be bound by them. If you do not agree to the Terms, do not use the App.

1. Introduction

The TaskFLY app is a mobile task management app available on the iOS platform (iPhone, iPad). It allows users to create, manage and track tasks, set notifications and use other features such as statistics and customizations. The app works on a freemium model with a free version and a paid version of TaskFLY PRO.

2. License to use

2.1 Limited license: We grant you a non-exclusive, non-transferable, revocable license to use the App on your personal device solely for non-commercial purposes and in accordance with these Terms.
2.2 Restrictions: You may not:

Copy, modify, distribute or sell the App or any part of it.
Attempt to reverse engineer, decompile or extract the source code of the Application.
Use the App for illegal or unauthorized purposes.
Lease, sublicense or otherwise make the App available to third parties.

3. Accessing and using the App

3.1 Age restrictions: The app is suitable for all ages and contains no content unsuitable for children.
3.2 Equipment requirements: The app requires a compatible iOS device and access to the App Store for downloads and updates.
3.3 Permits: The app requires permission to send notifications for task reminders. No other system permissions (e.g. access to location, contacts or camera) are required.
3.4 User responsibility: You are responsible for:

Secure your device and the data you enter into the App.
Compliance with these Terms and Conditions and applicable law.
Use the latest version of the App to access the latest features and security updates.

4. Business model and subscription

4.1 Freemium model:

Basic version: Free with a limit of 3 active tasks.
TaskFLY PRO: The paid version (€1.99 per month) unlocks all features, including unlimited tasks, dark mode, daily reminders and default settings.

4.2 In-app purchases:

The TaskFLY PRO subscription (identifier: com.aesa.taskfly.pro.monthly) is managed through Apple StoreKit.
Price: €1.99 per month (may vary by region).
Trial period: 7 days free.
Auto-renew: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

4.3 Cancellation of subscription:

You can cancel your subscription at any time in the iTunes/App Store settings on your device.
Instructions. Settings > [Your name] > Subscriptions, select TaskFLY PRO and select "Cancel subscription".
The cancellation will take effect at the end of the current subscription period.

4.4 Refunds:

Refund requests are handled solely by Apple according to their App Store policy.
For a refund, contact Apple Support via App Store > [Your Account] > Request a Refund.

5. Intellectual property

5.1 Ownership: All intellectual property rights in the Application, including its design, source code, graphics and content (other than User Generated Data), belong to AESA Group, SE or its licensors.
5.2 User data: The tasks and settings you enter in the App belong to you. We do not claim any ownership rights in this data.
5.3 Brand: The name "TaskFLY" and related logos are trademarks of AESA Group, SE. Their use without our permission is prohibited.

6. Limitation of liability

6.1 No guarantees: The Application is provided "as is" without warranties of any kind, either express or implied, including warranties of uninterrupted availability, error-free or fitness for a particular purpose.
6.2 Damage limitation: To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the App, including loss of data or profit.
6.3 Backup: You are responsible for backing up the data entered into the Application. Uninstalling the Application will result in the deletion of all locally stored data.

7. Termination of use

7.1 Termination by the user: You can stop using the app at any time by uninstalling it.
7.2 Termination from our side: We may terminate or restrict your access to the App if:

You are in breach of these Terms.
You are using the App for illegal or unauthorized purposes.
This is necessary for legal or technical reasons.
7.3 Consequences of termination: When you stop using the App, you will lose access to the App and all data stored locally on your device.

8. Changes to the Terms and Conditions

8.1 Updates: We may update these Terms from time to time to reflect changes in the App, the law or our practices.
8.2 Notice: We will keep you informed of significant changes:

By notification in the App.
By updating the "Last Updated" date at the beginning of these Terms.
By posting the updated Terms on our website (if available).
8.3 Continued use: By continuing to use the App after updating the Terms, you agree to the new Terms.

9. Governing Law and Jurisdiction

9.1 Governing law: These Terms are governed by the laws of the Slovak Republic.
9.2 Jurisdiction: Any disputes arising in connection with these Terms or the use of the Application shall be resolved by the courts of the Slovak Republic, specifically the court in Trnava, unless otherwise provided by law.
9.3 Consumer rights: If you are a consumer, these provisions do not affect your statutory rights under EU law or the laws of your country.

11. Miscellaneous

11.1 Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
11.2 Full agreement: These Terms constitute the entire agreement between you and us regarding your use of the App and supersede any prior agreements.
11.3 Language: These Terms and Conditions are drafted in English. Any translations are for informational purposes only, and in the event of a conflict, the Slovak version shall prevail.
